David Walden-Smith is a financial remedies specialist with over 35 years experience at the Bar. Described by Chambers & Partners as “just superb” and “a tremendous arbitrator”, most of his time is now spent sitting as a private judge. Having been a qualified Family Arbitrator since the inception of the IFLA scheme in 2012, he has huge experience of conducting such hearings. He was counsel in the Court of Appeal case of Haley v Haley [2021] 1 FLR 1429, which affirmed the proposition that an Arbitral award in a financial remedies case is entirely akin to a decision of a Judge. David also hears very many private FDRs and conducts Early Neutral Evaluations. He is prepared to travel and conducts hearings in Chambers, at solicitor’s offices or elsewhere, according to the parties’ preference. He is also entirely comfortable conducting hearings over Zoom, Teams or any other suitable medium. His view of the privatised dispute resolution process is that, unlike a judge in court, with an over-busy list, he has the advantage of being able to pre-read in detail and to concentrate on just the one case. This enables him to provide a bespoke service and a far more considered indication. His experience is that solicitors and lay clients have found that the additional cost involved in the provision of a “private judge” – shared between the parties – to be extremely modest when compared with the overall expense of their litigation. The advantage to the parties of a tribunal who is dedicated exclusively to their case is invaluable.

Following a decade in which Peter appeared in the Supreme Court twice (in Agbaje and Sharland) and in the Court of Appeal in a number of other leading cases (including Prest, Brack and Hart), Peter took Silk in 2020. He continues his high-profile appellate work, most recently leading the wife’s legal team in her successful and ground-breaking outing to the Court of Appeal in the latest stage of the decade-long Goddard-Watts litigation.

Peter specialises in all aspects of the law relating to relationship finance, with his work encompassing matrimonial finance and claims for financial provision for children, with an emphasis on complex financial cases involving substantial assets, trust structures, tax and valuation issues and/or requiring injunctive relief and/or third party disclosure; international jurisdictional disputes; and the drafting and enforcement of pre-nuptial, post-nuptial and cohabitation agreements. He has particular expertise in the law on setting aside orders for non-disclosure (the subject matter of Sharland and Goddard-Watts) and on proceedings for contempt of court (at issue in Prest and Hart).

Peter prides himself on providing top-quality client care. He considers it essential that his clients are given the information and time to understand the advice he is giving and that he is available throughout proceedings to assist, if called upon to do so. He is ranked as a leader in his field in Chambers & Partners, Legal 500 and Spears 500. The 2022 volume of Legal 500 records that “Peter is the most charming intellect in the business. He is a wonderful advocate who makes every client feel special and in the right hands.” Whilst the 2023 volume of Chambers & Partners describes him as “a fantastic person to pick up the phone to and run issues by. He’s personable, charismatic, and excellent. He’s a nice man with a great intellect who delivers results” and as having “a quick brain and an easy rapport with clients”.

Peter has utilised his standing in the profession and rapport with clients to develop a busy additional practice as a Private FDR evaluator and has an enviable reputation for promoting settlement, even in the most contentious of cases.

Recent cases include W v C (Financial Remedies: Appeal: Non-Disclosure) [2013] 2 FLR 115 (establishing for the first time the ambit of the duty of disclosure where one spouse does not press for full detailed disclosure from the other); H v S (Recognition of Overseas Divorce) [2012] 2 FLR 157 (establishing for the first time that a Saudi talaq divorce may be entitled to be recognised in English law, so as to allow a wife to bring proceedings under Part III of the MFPA 1984); Lawrence v Gallagher [2012] 2 FLR 643 (landmark Court of Appeal decision – the first ever Civil Partnership divorce case); and Sekhri v Ray [2013] All ER (D) 350 (Jul) (establishing domicile for two spouses both resident in Singapore in order to found jurisdiction for an English petition on the basis of both domiciles).

Professional Practice

Head of Chambers between 2016 and 2021. Professional practice based mainly upon financial remedy work, specialising in a wide range of big money divorce, family and offshore trusts, international finance cases, TOLATA, pre-nuptial and cohabitation agreements and disputes, Schedule 1 Children Act claims and leave to remove. More recently reported cases (listed below) have included two successful Supreme Court appeals - the seminal Wyatt v Vince, acting for the ultimately successful wife, and Mills v Mills (the lifetime maintenance case) for the husband; appearances in the Court of Appeal have included the very recent, long running case of Xanthopoulos v Rakshina [2024] EWCA Civ 84/ 100 which involved very significant Russian assets, 12 LSPO orders in favour of the husband,  and a costs bill for the financially stronger party (the wife) of some £9m. Other Court of Appeal cases have involved the similarly contested Villiers v Villiers [2022] EWCA, a successful appeal against the judgment of Mostyn J [2021] EWFC; Re R, acting for the mother in an internal relocation case; Morgan v Hill, a leading Schedule 1 authority; El Faragy (the ‘judicial humour’ case) and Shield v Shield, a long-running family trust case in which the parties’ son intervened to make a claim based upon promissory estoppel. Philip has a particular reputation for persistence in long running and difficult cases, often but not exclusively for wives, in which disclosure and cooperation have proved challenging. In addition to his court and advisory work, Philip is an enthusiastic supporter of early intervention and the alternative dispute resolution procedures (mainly the Private FDR) championed by 29 BR. He took a proactive role in the creation and design, within Chambers, of our own mediation and private FDR suite of conference rooms, and in addition to the reported decisions listed below has acted in a substantial number of matters, mainly in the High Court, which have settled following early neutral evaluation or the private FDR process. Philip is a trained arbitrator and consultant editor of Family Affairs, the FLBA’ s magazine. In 2022 he was nominated Family Silk of the Year by both Family Law and the Legal 500.

Annabel Wentworth accepts instructions in all areas of the law concerning children, including private and public law. In private law she often acts for parents in disagreements over living and contact arrangements. Her work includes contact and residence disputes, declarations of parentage, internal relocation and leave to remove from the jurisdiction. In public law, she primarily represents children and parents involved in complex proceedings involving serious allegations of abuse of children, often including multiple experts. This has extended to fatal or near fatal injuries within the family. She has extensive experience of acting for vulnerable clients.

  • Recommendations

"I have instructed Annabel to represent children and parents in the County Court and FPC, for findings of fact and at the welfare stage. The cases varied in complexity, from non accidental injury to chronic neglect, drug and alcohol issues and domestic violence. Her approach on all matters is analytical, she is well prepared and informed, imaginative in approach. Annabel has an easy manner with clients, relaxed, professional and constructive. Above all she is a good lawyer who is well respected by the court."
    Sarah Whitby - Heald Nickinson
“I have instructed Annabel on children matters since the outset of my career. This has included many cases with local authority involvement, serious medical or criminal issues and allegations of domestic abuse and violence. Annabel always approaches matters sensitively and clients and others like and respect her. She is pragmatic, fair and gives clients very clear advice on the court’s likely approach which is generally spot on. She is wonderful to work with.”

Alexis is joint Head of Chambers (together with Nicholas Allen QC). She has specialised in divorce and matrimonial financial claims (including financial claims for children) for more than 30 years. The backbone of her work is complex financial remedy cases, although she does some children (mainly re-location) work. Alexis has a reputation as a tough negotiator, managing cases in a constructive basis to minimise litigation, but essentially, is recognised in all the directories as a formidable litigator. She was nominated as Family Silk of the Year by Chambers & Partners in 2020. Alexis is a qualified arbitrator (Finance) through the Institute of Family Law Arbitrators scheme. She was originally appointed as a Crown Court Recorder in 2010 and since 2014 sits as a Recorder in the Family Court (in both public and private law).
